1. What is Personal Information?
“Personal Information” is information that, either alone or in combination with other information, identifies or relates to a particular individual. Examples of Personal Information include, among others, name, email address, phone number, mailing address, and online identifiers.
2. Types of Personal Information SMS Collects and Uses
A. Personal Information that you provide SMS
To provide you the Services, in various places within the Services, SMS may request you provide SMS certain Personal Information. SMS does not collect any Personal Information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs.
For example, when you choose to create an account, SMS may request you provide certain Personal Information, including, but not limited to:
Cell phone number;
Date of birth;
Login information associated with your Gmail account or social media accounts that you use to connect to the Services (this could include, for example, your Facebook or Instagram account).
If SMS offers and you elect to make an online purchase, the Services will redirect you to a third-party service provider to complete the transaction. SMS is not responsible for the third party’s conduct related to your payment information.
SMS will indicate when you create an account whether a particular field of Personal Information is mandatory or optional. If you choose not to provide certain Personal Information, SMS may not be able to provide the requested Services.
B. Personal Information SMS Automatically Collects from You
SMS collects the following types of Personal Information automatically through your use of the Services:
Cookies, Device Identifiers, and Similar Technologies
Most browsers provide you with the ability to block, delete, or disable cookies, and your mobile device may allow you to disable transmission of unique identifiers and location data. If you choose to reject cookies or block device identifiers, some features of the Services may not be available, or some functionality may be limited or unavailable. Please review the help pages of your browser or mobile device for assistance with changing your settings.
To assist us with analyzing the traffic to the Services through cookies or similar technologies, SMS may use analytics services, including Google Analytics. For more information on Google Analytics’ processing of your information, please see “How Google uses data when you use our partners' sites or apps.”
To improve the accuracy of the Services, SMS may track your location-based information from your mobile device, either continuously or while you are using the Services. If you wish to change SMS’s access or permissions, you may be able to do so in your mobile device’s settings menu.
Log File Information
When you use the Services, SMS’s servers automatically record information, including your Internet Protocol address (“IP Address”), browser type, referring URLs (e.g., the site you visited before coming to the Services), domain names associated with your internet service provider, information on your interaction with the Services, and other such information (collectively, “Log File Information”). SMS may also collect similar information from emails sent to you which then help SMS track which emails are opened and which links are clicked by recipients.
3. How SMS Uses Personal Information
SMS uses or in the future may potentially use Personal Information for the following purposes:
Offering the Services to you;
Administering and improving the Services;
Enabling secure use of the Services;
Sending you information and promotional materials;
Protecting SMS’s rights and intellectual property;
Meeting legal obligations; and
For other purposes related to the reasons for which you provide Personal Information.
SMS will retain your Personal Information only as long as necessary to fulfill the purposes for which SMS collected and processed the Personal Information, or as required by applicable laws.
4. Disclosure of Personal Information
SMS will not disclose Personal Information except as set forth in this Policy. This Section describes to whom SMS discloses Personal Information and for what purposes:
Service Providers. SMS engages service providers to perform tasks on its behalf and to assist in operating the Services. For example, SMS may use third-party service providers to provide the necessary hardware, software, networking, storage, and related technology required to operate the Services. SMS takes commercially reasonable steps to help ensure its service providers provide at least the same level of protection for Personal Information as SMS does.
Companies Involved in Mergers and Acquisitions Transactions. If SMS sells or otherwise transfers part or the whole of its business or assets to another organization (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, or liquidation), any Personal Information collected through the Services may be among the items sold or transferred.
Law Enforcement, Government Agencies, and Courts. SMS may disclose Personal Information at the request of law enforcement or government agencies; in response to subpoenas, court orders, or other legal process; to establish, protect, or exercise SMS’s rights; to defend against a legal claim; to protect the rights, property, or safety of any other person; or as otherwise required by law.
5. How SMS Protects Personal Information
In accordance with industry standards, SMS uses administrative, technical, and physical security measures to help protect your Personal Information under SMS’s control. However, while SMS attempts to ensure the integrity and security of Personal Information, SMS cannot guarantee that its security measures will prevent third parties such as hackers from illegally obtaining access to Personal Information. SMS does not represent or warrant that Personal Information about you will be protected against, loss, misuse, or alteration by third parties.
6. Retention and Deletion
As discussed above, SMS keeps your Personal Information only as long as necessary to fulfill the purposes for which it was collected and processed, including for the purposes of satisfying any legal, regulatory, accounting or reporting requirements. In some circumstances, SMS may de-identify, aggregate, or otherwise anonymize your Personal Information consistent with applicable laws and industry standards so that it can no longer be associated with you, in which case it is no longer treated as Personal Information.
7. Accessing, Updating, or Deleting Personal Information
If you would like to otherwise access, update, or delete Personal Information about you, you may submit a request to SMS by using the contact information in Section 13 (How to Contact SMS) below.
8. Opting Out of Receiving Electronic Communications
To provide you information regarding the Services, SMS may send you newsletters, marketing materials, surveys, or other information via email, text, or other electronic method (“Communications”). You may choose to stop receiving Communications by clicking on the conspicuous “Unsubscribe” link located at the bottom of any Communication SMS sends to you. Please note that certain Communications are necessary for the proper functioning and use of the Services and you may not have the ability to opt out of those Communications.
9. International Use of the Services
If you use the Services outside the United States, please be aware that Personal Information may be collected, stored, and processed in the United States. SMS will not transfer Personal Information internationally. Please be aware that the data protection laws of the United States might not be as comprehensive as those in your country.
10. Must be Sixteen (16) Years Old to Use the Services
The Services are intended to be used solely by individuals sixteen (16) years of age or older. SMS does not knowingly collect or solicit Personal Information from minors under the age of sixteen (16). In the event that SMS learns that SMS has collected Personal Information from a minor under the age of sixteen (16), SMS will promptly take steps to delete that information.
11. Third Party Links
SMS is not responsible for the practices employed by any websites or services linked to or from the Services, including the information or content contained within them. A link to a third party’s website should not be construed as an endorsement. SMS encourages you to investigate and ask questions before disclosing Personal Information to third parties.
12. Changes to the Policy
SMS may modify or update this Policy from time to time, so please review it periodically. If SMS makes a change to this Policy that, in its sole discretion, is material, SMS will notify you as appropriate under the circumstances. Unless otherwise indicated, any changes to this Policy will apply immediately upon posting to the Services.
